JUDGMENT Manoj K. Tiwari, J. - Division Bench of this Court in WPPIL No. 68 of 2016 had directed all the District Magistrates to ensure that no mining activity takes place one kilometer upstream or downstream of the bridges throughout the State of Uttarakhand. 2. Alleging non-compliance of the said order, this contempt petition has been filed by the petitioner. 3. A compliance affidavit has been filed by Mr. Neeraj Kharwal, District Magistrate, Udham Singh Nagar. In para 3 of the said affidavit, it has been stated that District Magistrate has passed an order on 09.07.2018 providing that all mining activities within one kilometer upstream or downstream near the bridges have been stopped. 4. Learned counsel for the petitioner submits that mining lease granted in favour of one Mr. Ashish Sehgal has not been cancelled. 5. Opposite party has taken stand in the counter affidavit that the said mining lease was granted by the State Government, therefore, it is the State Government alone who can cancel the lease. 6. By that as it may, the fact remains that the only direction was that no mining activity shall be undertaken within one kilometer from the upstream or downstream from the bridges. The direction nowhere provide for cancellation of mining lease. It is not the case of the petitioner that mining activity was undertaken within one kilometer from any bridge. 7. In such view of the matter, this Court is of the considered opinion that it is not the case of willful disobedience of the order passed by Writ Court. 8. Accordingly, the contempt petition is closed. Notice issued to the opposite party is hereby discharged.
