JUDGMENT Manoj Kumar Tiwari, J. - Since common questions of fact and law are involved in these writ petitions, therefore these petitions are clubbed together and are being heard & decided together. However, for the sake of convenience, facts of WPSS No. 1335 of 2021 are being considered. 2. Petitioner’s husband was engaged as Daily Wager in Public Works Department. On account of death of petitioner’s husband, petitioner was given appointment on compassionate ground as a Daily Wager. Presently, she is serving in N.H. Division, Almora, since 06.10.2010. 3. By means of this writ petition, petitioner has sought the following reliefs: "I. Issue a writ, order or direction in the nature of mandamus commanding the respondents to regularize the service of the Petitioner, treating her as a permanent employee appointed under the dying in harness rules w.e.f. 11.11.2020 and to pay her all consequential benefits forthwith as and from when it became due; II. Issue a writ order or direction in the nature of mandamus commanding the respondents to give admissible pay scale to the Petitioner as is being drawn by the other regular employees, counterparts in the department." 4. Without expressing any opinion on the merits of the claim made by the petitioner, this Court thinks that ends of justice would be met, if petitioner(s) is permitted to make representation(s) to Competent Authority, which shall be decided within some specified time frame. 5. Accordingly, the writ petitions are disposed of with liberty to petitioner(s) to make representation(s) to Competent Authority, within two weeks from today. If such representation(s) is made within the stipulated period, the Competent Authority shall consider petitioners’ claim and take appropriate decision, in accordance with law, within eight weeks from the date of receipt of representation(s) alongwith certified copy of the order.
