JUDGMENT Manoj K. Tiwari, J. - Writ Petition (S/S) No. 428 of 2020 filed by the petitioner was disposed of vide judgment dated 25.11.2020 with a direction to the Municipal Board, Nainital to decide petitioner's representation sympathetically within four months. 2. Alleging non-compliance of the said judgment, this contempt petition has been filed by the petitioner. 3. In sequel to the order dated 18.10.02021, Mr. Sachin Negi, Chairman, Municipal Board, Nainital and Mr. Ashok Verma, Executive Officer, Municipal Board, Nainital are present before the Court. They made a statement that the matter of the petitioner was referred to Deputy Director, Audit, Dehradun, Uttarakhand and a communication dated 19.07.2021 has been received from Directorate Audit, according to which, the amount payable as pension has been revised to â35,900/- in place of â34,900/-. 4. Mr. D.S. Patni, learned Senior Advocate appearing for the opposite parties submits that mistake in the Pension Payment Order now stands rectified. Learned Senior Advocate for the opposite parties, on instructions, has assured the Court the 50% of arrear of pension will be released within three months to the petitioner and the remaining amount shall be released within three months thereafter. 5. Mr. Anil Anthwal, learned counsel for the petitioner then submits that the order passed by Writ Court has now stands complied with. 6. In such view of the matter, the contempt petition is closed. Notices issued to the opposite parties are hereby discharged. However, petitioner shall be at liberty to approach the appropriate forum for redressal of his grievance, if any.
