JUDGMENT : 1. Heard Sri Anand Kumar Singh, learned counsel for the petitioners and Sri Vineet Pandey, Learned Chief Standing Counsel assisted by Sri B.P. Singh Kachhawa, Learned Additional Chief Standing Counsel. 2. This writ petition has been filed praying for the following reliefs:- “(I) A writ, order or direction in the nature of certiorari quashing the impugned dated 11.12.2020 passed by the respondent no. 3. (II) A writ, order or direction in the nature of mandamus directing the respondent nos. 2 & 3 to permit the petitioners to run the hospital as a designated hospital L-3 for the treatment of Covid-19 Patients (Corona patients).” 3. By the impugned order dated 11.12.2020 passed by the respondent no.3 i.e. Chief Medical Officer, Varanasi, the petitioner's hospital has been restrained from giving treatment to Covid patients and to run the hospital as Covid-19 Hospital, on the allegation that the petitioner's hospital has realized higher amount than the prescribed amount from a Covid-19 patient namely Sri Anand Kumar Mishra, who has made a complaint dated 27.08.2020 against the petitioners. 4. It appears that the State Government has issued a Guideline/ Circular dated 10.09.2020, in exercise of powers conferred under the Epidemic Diseases Act 1897 and the Uttar Pradesh Epidemic Disease Covid-19 Regulations 2020.

It appears that vide letter dated 16.07.2020 the respondent no.3 i.e. The Chief Medical Officer, Varanasi has granted permission to the petitioner's hospital for treatment of Covid-19 patients and to use 20 beds for L1, 15 beds for L2, 15 beds for L3 Covid-19 patients. It appears that a complaint was made by one Sri Anand Kumar Mishra against the petitioner's hospital for charging some excessive amount for treatment. Consequently a notice dated 22.08.2020 was issued by the respondent no.3 to the petitioner's hospital asking for explanation and the petitioner submitted a detailed explanation dated 25.08.2020. However, without considering the reply, the impugned order has been passed by the respondent no.3 even without recording that what amount has been found by him to have been charged excessively by the petitioner's hospital from a Covid-19 patient. 6. This Court take judicial notice of the fact that presently there is a spike rise in Covid-19 patients in the State of Uttar Pradesh particularly in districts Varanasi, Lucknow, Allahabad and Kanpur. In Government Hospitals adequate beds are not available to accommodate the Covid-19 patients for their treatment. The Government itself is engaging various private nursing homes and hospitals for treatment of Covid-19 patients. Under the circumstances, the impugned order does not appeal to reason that the petitioner’s hospital itself be restrained from giving treatment to Covid-19 patients, merely on the allegation of a patient that some excessive amount was charged by it from him. That apart the impugned order has been passed by the respondent no.3 completely ignoring the explanation submitted by the petitioner. 7. For all the reasons aforestated the impugned dated 11.12.2020 passed by the respondent no.3 cannot be sustained and is hereby quashed. Learned Chief Standing Counsel prays that liberty may be granted to the respondent no.3 to pass an order afresh in accordance with law, if required under the prevailing situations. 8. We have considered the request of the learned Chief standing Counsel and we accept it. Therefore, liberty is granted to the competent authority to pass an order afresh, in accordance with law, under the Epidemic Diseases Act 1897 and the Uttar Pradesh Epidemic Disease Covid-19 Regulations 2020, if still required under the prevailing situations, after affording opportunity of hearing to the petitioners. 9. Accordingly, the writ petition is allowed to the extent indicated above.
