JUDGMENT : AVNEESH JHINGAN, J. 1. The matter is taken up for hearing through video conference due to COVID-19 situation. 2. These are two petitions seeking anticipatory bail in FIR No. 332, dated 7th December, 2020, under Sections 406, 420, 120-B of IPC, registered at Police Station 'B' Division, Amritsar. 3. FIR was filed at the behest of Harbhajan Singh. As per the FIR, the complainant is a gold smith running business in the name of M/s Meenu Jewellers at Amritsar. The allegations are that on 2nd March, 2020, petitioners took gold ornaments from the complainant to show the same to their customers. They were handed over gold ornaments weighing 1701.660 grams. It was stated that neither the ornaments were returned nor the amount was paid, instead Ranjit Kaur (petitioner in CRM-M-4345-2021) proposed to transfer a plot. Later on, Ranjit Kaur refused to enter into agreement to sell of the said property. 4. Mr. Gursimran Singh Madaan, learned counsel for the petitioners submits that the matter has been compromised. It is contended that the issue was civil in nature. 5. Mr. Ramandeep Sandhu, Sr. D.A.G., Punjab, on instructions from S.I. Nirmal Kumar, endorses the version of learned counsel for the petitioners that parties have settled the matter and entered into a compromise. He further informs that quashing petition bearing CRM-M No.9951 of 2021, on the basis of compromise is filed. 6. Considering that allegations have the tone and tenor of commercial and civil dispute, the petitioners are granted anticipatory bail subject to their joining investigation within two weeks. In the event of arrest, the petitioners shall be released on bail subject to their furnishing adequate bail bonds to the satisfaction of the Investigating Officer. They are directed to join the investigation as and when called for. They shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. 7. The petitions are allowed. 8. In case of failure of petitioners to join the investigation, the State would be at liberty to file an application for recalling of this order. 9. Since the main case is allowed, CRM-4235-2021 in CRM-M-4345-2021 has been rendered infructuous. 10. A photocopy of this order be placed on the file of connected petition.
