ORDER 1. In wake of onslaught of COVID-19, abundant caution is being taken while hearing the matters in Court. 2. Learned counsel for the petitioner submits that the application under Order 39 Rule 1 and 2 and Section 151 CPC in a suit for permanent and perpetual injunction against the petitioner- defendant was dismissed by the learned court below on the ground that the patta documents were not inconformity with law. 3. Learned counsel for the petitioner further submits that the petitioner No.2 and respondent are real brothers and the petitioners are in long term possession, therefore, any kind of restriction upon them will not be in accordance with law. 4. Learned counsel for the respondent opposes the petition, which is against the appeal preferred upon dismissal of the application for temporary injunction, in which, status-quo order has been passed by the learned appellate court. 5. This Court, after hearing the learned counsel for the parties and seeing the appellate court's order, finds that the parties in the interest of justice and in the interest of peace and harmony are required to maintain the status-quo, particularly when the title of either of them has not been prima-facie made clear. 6. Thus, the order of learned appellate court does not call for any interference in the present writ petition and the same is accordingly dismissed. Learned court below shall make expeditious hearing of the suit. 7. Stay petition as well as all pending applications stand dismissed accordingly.
