ORDER : 1. Learned AAGs Shri Pankaj Sharma and Shri A.K. Gaur submit that the Directorate of Mines and Geology, Rajasthan shall be forwarding a proposal to the State Government for allocating a suitable sum of money from District Mineral Foundation Trust and State Mineral Foundation Trust for upliftment of the Child Care Institutions (CCIs) all across the State of Rajasthan. Further progress in this direction is expected within next three weeks. 2. Shri Govind Beniwal, Child Right Activist states that at numerous places in Rajasthan State, Chief Judicial Magistrates have been posted as Principal Magistrates in the Juvenile Justice Boards or have been given charge thereof in contravention of mandate of the Juvenile Justice Act. He further states that the bail applications of the children in conflict with law are not being decided in the letter and spirit of the statutory provision i.e., Section 12 of the Juvenile Justice (Care and Protection of Children) Act, 2015. 3. In view of the facts noted above, we hereby direct that a session for sensitization of all the Principal Magistrates of the Juvenile Justice Boards in Rajasthan shall be conducted at the Rajasthan State Judicial Academy at the earliest possible opportunity. 4. The Registrar General, Rajasthan High Court, Jodhpur shall respond to the submission of Shri Govind Beniwal regarding appointment of Chief Judicial Magistrates as Principal Magistrates contrary to the requirement of the Juvenile Justice Act. Shri Gaur, AAG further submits that request has already been made to the Registrar General, Rajasthan High Court for filling up the vacant posts in the Juvenile Justice Boards. Copy of this order shall be transmitted to Registrar General, Rajasthan High Court, Jodhpur forthwith. 5. List on 23.04.2021.
