ORDER : 1. This case is taken up through video conferencing. 2. At the request of learned counsel for the petitioner, the remaining defects, as pointed out by the office, is ignored for the present. 3. The present writ petition has been filed for issuance of direction upon the respondent nos. 1 and 3 not to take any action in Execution Case No. 11 of 2020 for evicting the petitioner from the shop in question. Further prayer has been made for issuance of direction upon the respondent no. 3 not to proceed further in Execution Case No. 11 of 2020 since the claim of the respondent no. 4 for vacating one shop out of four shops is not tenable, as he is already in possession of the same. 4. Mr. Ankit Kumar, learned A.C. to S.C. (Mines)-I, appearing on behalf of the respondent nos.1 to 3 submits that since the petitioner has not filed any revision petition under Section 37 of the Jharkhand Buildings (Lease, Rent and Eviction) Control Act, 2011 before the Commissioner, North Chotanagpur Division, Hazaribagh against the order dated 1st September, 2020 passed by Appellate Authority i.e. Deputy Commissioner-cum-District Magistrate, Bokaro-respondent no. 2 in J.B.C.A. Appeal No. 89 of 2020-2021, the petitioner’s prayer for staying the proceeding of Execution Case No. 11 of 2020 by directly filing the present writ petition is not tenable in law. 5. On this, Mr. J.K. Pasari, learned counsel for the petitioner, submits that the petitioner shall immediately file revision petition before the Commissioner, North Chotanagpur Division, Hazaribagh-cum-Revisional Authority under the said Act, 2011. 6. In view of the said submission, the present writ petition is disposed of with a liberty to the petitioner to prefer a revision petition under Section 37 of the said Act, 2011 in the Court of Commissioner, North Chotanagpur Division, Hazaribagh and to pray for an interim order against the steps being taken by the respondent no. 3 in Execution Case no. 11 of 2020. 7. I.A. No. 3790 of 2021 is also disposed of.
