JUDGMENT : AVNEESH JHINGAN, J 1. The matter is taken up for hearing through video conference due to COVID-19 situation. 2. Petitioner prays for grant of regular bail in case arising out of FIR No.17 dated 21.02.2020 registered under Sections 419, 420, 467, 468, 471, 120-B of the Indian Penal Code at Police Station, Kalka District Panchkula. 3. The FIR was registered on the grounds that accused had sold the property of one Prem Kumar and for registration of transaction, some one impersonated as Prem Kumar. 4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated and is in custody since 11.2.2021. He had only typed the documents for Registry. Nothing is to be recovered. He was not named in the FIR and is not the beneficiary. 5. Learned State counsel opposes the prayer for bail. He submits that in the disclosure statement Shubham stated that the petitioner had charged Rs.10,000/- for preparing the Registry. He fairly submits that though challan is not presented but CPU was taken in possession by the police and would be sent to the lab to retrieve data. 6. Heard learned counsel for parties. 7. Petitioner is in custody since February, 2021. Some of the co-accused were granted bail by this Court. No recovery is to be made. As per the case of the prosecution, the petitioner had only helped in preparing the documents. The conclusion of trial is likely to take time. Taking into consideration the totality of the circumstances and without commenting on the merits of the case, the petitioner is directed to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of the concerned trial court/Duty Magistrate. 8. The petition is allowed.
