JUDGMENT Raghvendra Singh Chauhan, CJ. - The petitioner, Weekly Sunday Market Welfare Society, has filed the present writ petition (PIL) for seeking a parcel of land for carrying out the Weekly Sunday Market organized by the Society. 2. In pursuance to the order dated 03.03.2021, the respondent-Municipal Corporation, Dehradun was directed to give the options to the petitioner-society for the establishment of its Sunday Market. 3. Consequently, the respondent No.5 gave five options to the petitioner-society. 4. According to the supplementary affidavit filed by the petitioner-society, they have agreed to take a parcel of land which is said to be situated near ISBT (about 500 mts. from the ISBT) & adjacent to petrol pump. However, the photographs submitted with the supplementary affidavit clearly reveal that lot of trash/garbage is lying at the site. Therefore, the petitioner-society prays that the respondent No.5 should be directed to make the place appropriate for running the Sunday Market. 5. Since the very livelihood of the members of the petitioner-society depends in organizing and holding the Sunday Market, since it is the duty of the State to provide employment to its people, the respondent No.5 is directed to permit the petitioner-society to carry on its business on the said land. Moreover, the respondent No.5 is directed to make the place appropriate enough for the petitioner-society to carry on its business on the said land. The said exercise shall be completed by the respondent No.5 within a period of three weeks. After the place has been made appropriately safe for running of the business of the petitioner-society, the petitioner-society shall be permitted to hold the Sunday Market on every Sunday of the month. 6. With these directions, the writ petition is disposed of.
