ORDER : I.A.Nos.1 & 2 of 2021 1. These miscellaneous petitions are filed by the petitioners seeking to record compromise between the revision petitioner and respondents 1 and 2 in Crl.R.C.No.3150 of 2018 and compound the case in M.C.O.P.No.90 of 2016 on the file of XIV Additional District & Sessions Judge-cum-Family Judge, Vijayawada. 2. It is stated in the affidavit filed in support of the petition that during the pendency of criminal revision, at the instance of elders, the matter was amicably settled between the revision petitioner and respondents 1 and 2. It is stated that both parties have entered into compromise as per the terms and conditions in the Memorandum of Understanding and the same was recorded by this Court in 1st F.C.A.No.495 of 2018 dated 25.07.2019. The respondent-wife stated that in view of compromise entered between the parties, there is no need to continue maintenance proceedings and she has no objection for allowing the revision by compounding the same. It is stated that both the parties have voluntarily entered into compromise and to that effect a joint memo is also filed before this Court. 3. Both the parties are present and they are identified by their respective counsels. Further, it is stated by both the parties that they have voluntarily entered into compromise due to intervention of elders and well wishers. The complainant submitted that in view of the compromise entered between the parties, continuation of maintenance proceedings is not necessary and the same can be compounded and Crl.R.C.No.3150 of 2018 can be allowed. 4. Therefore, taking into consideration the facts of the case, as the parties have compromised, permission is granted to compound the offence and compromise is recorded as per the terms and conditions mentioned in the petition. Accordingly, these petitions are ordered. Criminal Revision Case No.3150 of 2018 5. In view of the order passed in I.A.Nos.1 & 2 of 2021, this criminal revision case is allowed and the common order dated 20.08.2018 in F.C.O.P. (M.C.) No.90 of 2016 on the file of XIV Additional District & Sessions Judge-cum-Family Judge, Vijayawada is set aside. No order as to costs. 6. Registry is directed to annex the copy of order dated 25.07.2019 passed by this Court in F.C.A.No.495 of 2018 and also Memorandum of Understanding dated 31.010.2018 to this Order. 7. As a sequel, miscellaneous applications pending if any, shall stand closed. No costs.
