JUDGMENT Anupinder Singh Grewal, J. - Case taken up through video conferencing. 2. The petitioner is seeking anticipatory bail in FIR No.100 dated 28.09.2019, under Sections 21/29 of the NDPS Act, registered at Police Station Mohkampura, District Amritsar. 3. Learned counsel for the petitioner contends that 245 intoxicating tablets were allegedly recovered from the co-accused namely Ashu Malik and Vishal, who were arrested at the spot. The recovery is non-commercial in nature. The petitioner had been arraigned as accused on the statement of coaccused. 4. This Court, by the order dated 11.02.2021, had directed the petitioner to appear before the Investigating Officer and join the investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C. 5. Learned State counsel, on instructions from ASI Ranjit Singh, states that although the petitioner has joined investigation but there is another case against him. 6. In view of the above especially when the petitioner has been arraigned as an accused on the statement of co-accused from whom recovery of non-commercial quantity has been effected and the petitioner having joined investigation, the order dated 11.02.2021 granting interim bail to the petitioner is made absolute. 7. However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so. 8. The petition stands disposed of.
