JUDGMENT Manoj Kumar Tiwari, J. - According to the petitioner, he had appointed one Mr. Lovely Singh as his Manager to look after his transport business, however, the Manager has illegally transferred petitioner's trucks in favour of Mr. Gurpreet Singh & Mr. Prince Pal Singh, on the basis of forged signatures. 2. According to the petitioner, transfer of registration of the trucks belonging to petitioner, in favour of Mr. Gurpreet Singh & Mr. Prince Pal Singh, is based on forged documents, therefore, transfer of registration deserves to be set aside. 3. Learned counsel appearing for the petitioner contends that petitioner has already made representation to Assistant Regional Transport Officer, Haldwani, District Nainital, on 01.12.2021, who may be asked to decide the same, expeditiously. 4. Learned State counsel, however, submits that petitioner has raised a dispute regarding ownership over the trucks in question and the authorities under Motor Vehicles Act cannot go into such dispute 5. Be that as it may, since petitioner's counsel has confined his prayer and prayed for a direction to Assistant Regional Transport Officer to take decision on petitioner's representation, therefore, the writ petition is disposed of with a direction to Assistant Regional Transport Officer, Haldwani to decide petitioner's representation, in accordance with law, one way or the other, within six weeks from the date of production of certified copy of this order along with copy of representation. 6. It goes without saying that principles of natural justice will have to be followed before passing any order in favour of the petitioner.
