JUDGMENT : AVNEESH JHINGAN, J. 1. This petition is filed for grant of regular bail in FIR No. 162, dated 6th August, 2019, under Sections 21, 22 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Kotwali, Kapurthala. 2. During the routine patrolling on 6th August, 2019, petitioner alongwith co-accused Balbir Singh were apprehended. 100 grams of Heroin was recovered from the conscious possession of the petitioner and 260 grams of Alprazolam from the co-accused. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 1st February, 2021. Earlier he was granted bail during the pendency of FSL report. The argument is that no recovery is to be made and the challan stands presented. 4. Learned State counsel opposes the prayer by submitting that the petitioner is involved in another FIR. 5. Learned counsel for the petitioner submits that the petitioner was granted anticipatory bail in that FIR. 6. Considering the custody period, the fact that the recovery from the petitioner is non-commercial and abliet the challan stands presented but the conclusion of trial is likely to take time, petitioner is granted bail subject to his furnishing requisite bail bonds to the satisfaction of the concerned Chief Judicial Magistrate/Duty Magistrate.
