ORDER : 1. The present writ petition has been filed for issuance of show cause to the respondent-Bank as to on what basis, the petitioner’s Joint Savings Account No. 31160937175 maintained with ADB Branch, SBI, Rajmahal, district-Sahibganj has been kept on hold. Further prayer has been made for issuance of direction upon the respondent nos. 1 and 2 to immediately make the said bank account of the petitioner operational and to allow him to withdraw money from the same. 2. The learned counsel for the petitioner submits that the petitioner is the customer of ADB Branch of the State Bank of India, Rajmahal, Sahibganj having a Joint Savings Account No. 31160937175, CIF No. 85782762910, Branch Code No. 3118, IFSC Code No. SBIN-0003118 as would be evident from the photocopy of the passbook (annexed as Annexure-1 to the writ petition). It is also submitted that transaction in the said bank account of the petitioner was though regular, however, on 20.04.2016 when the petitioner tried to withdraw the money from the said bank account, he was not permitted to do so. The petitioner also asked the respondent-Bank to disclose the reason for not allowing him to operate the said bank account, however, no information was provided to him. Finally, the petitioner filed a complaint before the banking ombudsman, Jharkhand, but the same was not entertained. A communication of the same was made to the petitioner by the banking ombudsman on 23.11.2017, a copy of which is annexed as Annexure-2 to the writ petition. Under the said compelling circumstance, the petitioner has filed the present writ petition. 3. Mr. Ratnesh Kumar, the learned counsel for the respondents, submits that the reason for not permitting the petitioner to operate the aforesaid bank account will be communicated to him by the competent authority of the bank within a time frame. 4. Having heard the learned counsel for the parties and keeping in view the nature of prayer made by the petitioner in the present writ petition as well as the submission of the learned counsel for the respondents, the present writ petition is disposed of with a direction to the respondent no. 4. Having heard the learned counsel for the parties and keeping in view the nature of prayer made by the petitioner in the present writ petition as well as the submission of the learned counsel for the respondents, the present writ petition is disposed of with a direction to the respondent no. 2 the Branch Manager, ADB Branch of the State Bank of India, Rajmahal, Sahibganj to disclose the reason to the petitioner as to why the aforesaid bank account is not being allowed to be operated by him within two weeks from the date of receipt/production of a copy of this order.
