ORDER 1. Heard learned counsel representing the parties. Perused the material available on record. 2. This misc. petition under Section 482 Cr.P.C. has been filed by the petitioner Praveen Singh for assailing the order dated 06.08.2020 passed by the District Magistrate, Jalore whereby, exercising powers under Section 411B Cr.P.C., the proceedings of Case No.03/2020 pending before the SDM, Chitalwana were transferred to the SDM, Jaswantpura. 3. The contention of Shri Pitaliya that Section 412 Cr.P.C. mandates that an order under Section 411 Cr.P.C. cannot be passed without recording reasons, carries weight. A perusal of the order dated 06.08.2020 indicates that no reasons have been assigned by the District Magistrate, Jalore before transferring the case from SDM, Chitalwana to SDM, Jaswantpura. Thus, the order dated 06.08.2020 is quashed. The SDM, Chitalwana is requested to decide the proceedings under Section 145 Cr.P.C. expeditiously. 4. Accordingly, the misc. petition as well as stay application are disposed of.
