The present writ petition has been filed for directing the respondents to immediately and forthwith sanction/approve the building plan submitted by the Hindu Undivided Family (HUF) comprising of the petitioner-Sunil Kumar Singh, Rahul Kumar Singh, Abhishek Kumar Singh, Smt. Mina Singh and Smt. Sudha Singh (since deceased) for making construction over the plot appertaining to R.S. Plot no. 74, sub-plot no. 74-A-2-2, 74-A-2-3, 74-A-2-4, Thana No. 203, Ward No. 35, village Hehal, P.S. Sukhdeonagar, District Ranchi (hereinafter to be referred as “the said land”) which was duly purchased by them by way of registered sale deeds on payment of consideration and the same has also been duly mutated, rent for which is being regularly paid and the said land is in their exclusive possession. 2. Learned counsel for the petitioner submits that the aforesaid HUF duly submitted the building plan prepared by an architect before the respondent-Ranchi Municipal Corporation (RMC) on 09.08.2017 along with relevant documents. Despite lapse of more than four years, the said building plan submitted before the respondent-RMC has been kept pending without assigning any cogent reason, which has compelled the petitioner to prefer the present writ petition. 3. Learned counsel for the respondent-RMC while referring the counter affidavit filed on behalf of the respondent nos. 1 and 2, submits that the building plan was submitted by the aforesaid HUF through online mode which was scrutinized by the software Pre-DCR. The applicant however failed to meet the essential requirements of the said software upon scrutiny and therefore the building plan was returned on 23.01.2018 to the Licensed Technical Person (in short “LTP”) i.e. the person entrusted by the applicant to submit online building plan with the remarks for resubmitting the building plan in Pre-DCR format. Thereafter, the building plan has not been submitted as was suggested vide online remarks dated 23.01.2018. 4. Considering the aforesaid stand taken in the counter affidavit filed on behalf of the respondent nos. 1 and 2, the HUF comprising of the petitioner is given liberty to submit the building plan through the concerned LTP within four weeks as per Pre-DCR format as suggested vide remarks dated 23.01.2018. On receipt of the said building plan, the concerned authority of the respondent-RMC on proper consideration shall take an appropriate decision on the same within two months from the date of submitting the same. 5.
