ORDER : 1. At the request of the learned counsel for the petitioner, the defects as pointed out by the office are ignored. 2. The present writ petition has been filed for issuance of direction upon respondent no. 2, the Deputy Commissioner, Deoghar to urgently hear Revenue Misc. Appeal (token no. RCMSON-21008091) filed by the petitioner on 15.09.2021 against the order dated 04.09.2021 passed by the respondent no. 3, the Sub-Divisional Magistrate, Deoghar in Encroachment Case No. 98 of 2021-22, whereby the petitioner has been directed to remove the alleged encroachment from the land appertaining to Mauza-Khijuriya, Than No. 420, Khata No. 5, Dag No. 34/63, District-Deoghar measuring an area of 1148 sq. ft. out of 44.83 acres treating the same to be public land. 3. Having heard learned counsel for the parties and considering the aforesaid limited prayer of the petitioner made in the present writ petition, the respondent no. 2 is directed to take up the concerned appeal preferred by the petitioner against the order dated 04.09.2021 passed by the respondent no. 3 in Encroachment Case No. 98 of 2021-22 and after providing due opportunity of hearing to the petitioner/his representative, to pass an appropriate order in accordance with law as expeditiously as possible preferably within two months from the date of receipt/production of a copy of this order. 4. The writ petition is accordingly disposed of with aforesaid observation and direction.
