JUDGMENT : Goverdhan Bardhar, J. 1. The instant criminal misc. petition has been filed by the petitioner under Section 482 Cr.P.C. against the order dated 17.08.2019 passed by the Court of Special Judge, POCSO Act, 2012 and Prevention of Children Atrocity Commission Act, 2005, Sawai Madhopur (for short 'the trial court') in Sessions Case No. 76/2018 (78/2017) [State of Rajasthan vs. Udai Singh] to the extent whereby the Investigating Officer (petitioner herein) has prayed to expunge the adverse remarks made in para Nos. 45 to 47 of the judgment passed by the trial court. The present criminal misc. petition has been filed by the petitioner with the following prayer :- "It is, therefore, humbly prayed that this misc.
The present criminal misc. petition has been filed by the petitioner with the following prayer :- "It is, therefore, humbly prayed that this misc. petition may kindly be accepted and allowed and expunged the adverse remark passed by the learned trial Court and directing the Additional Chief Secretary Home Department, Government of Rajasthan, Jaipur, Rajasthan to initiate departmental proceedings and ordered to take necessary action against the petitioner vide order dated 17.08.2019 passed by the learned trial Court in Session Case No. 76/2018 (78/2017) arising out of FIR No. 153/2017 registered at Police Station Bamanwas, District Sawai Madhopur." 3. Learned counsel for the petitioner has placed reliance on a judgment passed by this Court in Attar Singh Punia vs. State of Rajasthan: S.B. Criminal Misc. Petition No. 1335/2005 decided on 22.02.2008, wherein this Court has held as under:- "Therefore, in view of the settled preposition of law laid down by the Hon'ble Supreme Court and this Court in the cases of State of U.P. vs. Surendra Kumar Solanki (supra), Rajveer Singh vs. State of Rajasthan (supra) and Raghuveer Singh & Anr. vs. State (supra), the order impugned dated 26.09.2005 so far as passing stricture against the petitioner is concerned, is hereby quashed and set aside with direction that before passing stricture against the petitioner, provide him an opportunity of being heard and then pass fresh order in this regard. With these observations, the criminal misc. petition stands disposed of. The interim order dated 26.10.2005 granted by this Court stands rejected. The stay application also stands dismissed." 4. I have heard rival submissions of the respective parties and carefully gone through the judgment impugned. 5. As per the settled preposition of law laid down by this Court and Hon'ble the Supreme Court in various judgments, it is well settled that before any casting remarks are made by the Court against any person, particularly when such remarks could cause serious consequences on the future service career of the person concerned, he should have been given an opportunity of being heard in the matter in respect of proposed remarks or structures and such an opportunity is the basic requirement. 6.

Therefore, in view of the settled preposition of law and in the light of judgment passed by the Coordinate Bench of this Court in Attar Singh Punia (supra) and other cases, the impugned order dated 17.08.2019 to the extent of passing structure against the petitioner in para Nos. 45 to 47 is concerned, is hereby quashed and set aside with direction that no punitive action with regard to service career shall be taken against the petitioner for the aforesaid structure without an opportunity of being heard. 7. However, it will be open for the Administrative Department to examine the matter on facts independently without being influenced with the afore-quoted observations/remarks made by the Court below in its judgment dated 17.08.2019. The instant criminal misc. petition stands disposed of accordingly.
