JUDGMENT : The petitioner seeks for issuance of command against the respondents to pay the leave encashement, gratuity and other retiral benefit to the petitioner. 2. Indisputably the petitioner retired from the post of teacher on 31.05.2013 from recognized Madarsa Mazharul Uloom at Parsa, P.O. Marjadwa, District-West Champaran. 3. The question for consideration is whether a teacher employed in non-government aided minority school is entitled for retiral benefit. 4. Learned counsel for the petitioner has placed reliance on the resolution of the State Government bearing No.237 dated 20.02.1990, a copy at Annexure-1, as well as Memo No.2 dated 09.01.1990, a copy at Annexure-2, for his submission that petitioner is entitled for all the benefits including retiral benefits at par with the government school teachers. 5. On the other hand, learned counsel for the State-respondents contends that in the counter affidavit they have distinguished between the minority institution and the Madarsa. 5. On the other hand, learned counsel for the State-respondents contends that in the counter affidavit they have distinguished between the minority institution and the Madarsa. However, learned counsel could not explain when he was confronted with use of the word ‘Madarsa’ in resolution No.237 dated 20.02.1990 which reads as follows: fcgkj ljdkj] ekuo lalk/ku fodkl] ladYi Kkikad 237 fn0 20-2-90 fo"k;%& jkT; ds ekU;rk izkIr xSj ljdkjh vYila[;d izkFkfed@ek/;fed fo|ky;ksa] izLohd`r laLd`r fo|ky;ksa ,oa izLohd`r enjlksa ds f'k{kd@f'k{kdsRrj deZpkfj;ksa dks ljdkjh f'k{kd@ f'k{kdsRrj deZpkfj;ksa dh rjg osru] HkRrk ,oa vU; foRrh; lqfp/kk;sa iznku djus ds laca/k esaA i<+k x;k & jktdh; ladYi la0 2022 fn0 18-8-79] 179 fn0 22-11-81] 522 fn0 28-2-82] 172 fn0 24-3-84] 330 fn0 16-3-84] 273 fn0 25-3-89] 300 fn0 31-3-82] 372 fn0 13-4-83] 172 fn0 24-4-83 ,oa 360 fn0 31-3-84- jkT; ds izkFkfed@e/;@ek/;fed vYila[;d fo|ky;ksa] izLohd`r laLd`r fo|ky;ksa ,oa enjlksa ds f'k{kd ,oa f'k{kdsRrj deZpkfj;ksa dks ljdkjh f'k{kdksa dh Hkkafr osru ds vfrfjDr vU; lqfo/kk;sa iznku djus dh ekax vkrh jgh gSA bu fo|ky;ksa ,oa enjlksa esa dk;Zjr f'k{kd@f'k{kdsRrj deZpkfj;ksa dk osru ds vfrfjDr nh tk jgh egaxkbZ HkRrk] fpfdRlk HkRrk] vkokl HkRrk] uxj {kfriwfrZ HkRrk vkfn dks lqfo/kkvksa esa ,d:irk ugha gSA tgka ek/;fed vYila[;d fo|ky;ksa ds f'k{kd ,oa f'k{kdsRrj deZpkfj;ksa dks ljdkjh f'k{kdksa dh Hkkafr egaxkbZ HkRrk Lohd`r fd;k tk jgk gS ogh izLohd`r laLd`r fo|ky;ksa ds f'k{kdksa ,oa f'k{kdsRrj deZpkfj;ksa dks osru ds vfrfjDr dsoy 13 ¼rsjg½ fdLr ,oa enjlksa dks iw.kZ egaxkbZ HkRrk izkIr gks jgk gSA ijUrq vkokl HkRrk] fpfdRlk HkRrk] uxj {kfriwfrZ HkRrk ugha fey jgk gSA 2- fofHkUu vYila[;d fo|ky;ksa] izLohd`r laLd`r fo|ky;ksa ,oa izLohd`r enjlksa ds f'k{kd@f'k{kdsRrj deZpkfj;ksa dks leku :i esa lqfo/kk;sa miYkC/k djkus dk iz'u jkT; ljdkj ds fopkjk/khu FkhA ljdkj }kjk bl ij iw.kZ:is.k fopkjksijkUr fu.kZ; fy;k x;k gS fd jkT; ds xSj ljdkjh ekU;rk izkIr vYila[;d izkFkfed] e/; ,oa ek/;fed fo|ky;ksa rFkk izLohd`r xSj ljdkjh laLd`r fo|ky;ksa ,oa enjlksa ds f'k{kd ,oa f'k{kdsRrj deZpkfj;ksa dks osru ds vfrfjDr os lHkh lqfo/kk;sa nh tk; tks ljdkjh fo|ky; f'k{kd ,oa f'k{kdsRrj deZpkfj;ksa dks miyC/k gSa ,oa le;≤ ij tks jkT; ljdkj }kjk miyC/k djk;h tk;A 3- mijksDr fu.kZ; fnukad 1-1-90 ls izHkkoh gksxkA 4- bl ij gksus okys O;; ds laca/k esa i`Fkd ls vkns'k fuxZr fd;k tk;sxkA 5- ladYi esa foRr foHkkx dh lgefr ,oa eaf=ifj"kn dh Lohd`fr izkIr dj yh x;h gSA^^ 6. The aforesaid resolution makes it apparent that the State Government resolved to implement with effect from 01.09.1990 different facilities including salary and retiral benefit to the recognized non-government aided minority primary/middle/secondary schools, non-government Sanskrit Schools and Madarsa of the State at par with the teachers of the government schools. Therefore, there is nothing to deny the claim of the petitioner. 7. Hence, the respondents are directed to make payment of entire retiral dues to the petitioner within a period of three months from the date of receipt/production of a copy of this order, failing which the respondent would be liable to pay interest of 8% per annum on delayed payment till its actual payment. 8. Accordingly, this application stands allowed.
