JUDGMENT 1. Heard Mr. A.S. Siddiqui, learned Senior counsel assisted by Mr. D. Hynniewta, learned counsel for the petitioner and Mr. P.N. Nongbri, learned counsel for the respondent. 2. The writ petitioner is before this Court as he is apprehensive that he might be evicted from his allotted Stall by the respondent in view of the re-construction that is taking place, in Laitumkhrah Municipal Market. 3. Mr. P.N. Nongbri, learned counsel for the respondent submits that there is no such move and the apprehension of the writ petitioner is totally un-founded. An undertaking in this regard has also been recorded in an earlier order dated 27.10.2021 passed by this Court which is reproduced hereinbelow:- “3. Mr. Philemon Nongbri, learned counsel for the respondent invites my attention to the pleadings in para 14 and submits that the petitioner and other shop-keepers have already been relocated. So far as, the undertaking and the agreement to provide suitable Stall in the reconstructed market is concerned, Mr. Philemon Nongbri, learned counsel submits that the respondent-Municipal Board is willing to allocate suitable Stall to the petitioner and similarly situated persons and accordingly draft undertaking is also prepared, however, it is not finalized. Mr. Philemon Nongbri, learned counsel submits that once the draft is finalized by the shop-keepers including the petitioner then the same would be executed. The statement of Mr. Philemon Nongbri is accepted.” 4. In view of the circumstances, nothing survives for consideration in the instant writ petition, and it is expected that the authorities will proceed in accordance with law in allotting Stall and the execution of an agreement with the writ petitioner. 5. Accordingly, the instant writ petition stands disposed of.
