ORDER MA 948/2022 in W.P.(C) No. 502/2021 1. A compilation of additional documents has been filed by the Union of India. The learned Attorney General for India has, in particular, relied on the Minutes of the reconstituted Search cum Selection Committee[1] dated 31 May 2022 and 8 June 2022. [1]"SCSC" 2. As recorded in the earlier order of this Court dated 17 May 2022, the SCSC had recommended 28 candidates in the main list and 13 in the wait list out of which 16 were selected from the main list and 6 from the wait list. Thus, out of a total of 41 persons, 22 have been selected leaving 19 persons remaining to be appointed. 3. The Minutes dated 31 May 2022 would prima facie indicate that the SCSC discussed the appointment of six candidates who were recommended earlier on 21 September 2019 against the vacancies in the unreserved category of Accountant Members and OBC category of Judicial Members in the ITAT. This is again clarified on 8 June 2022. 4. The learned Attorney General submits that an affidavit will be filed by the Union of India. The affidavit shall also clarify whether the inputs and material pertaining only to six candidates were placed before the SCSC. 5. List on 26 July 2022.
