JUDGMENT : Salil Kumar Rai, J. The issue in the present petition under Article 227 of the Constitution of India is regarding the minimum period required for notice under Section 106 of the Transfer of Property Act, 1882 after amendment in the Act, 1882 by Central Act No. 3 of 2003. 2. It has been reported that the aforesaid issue has been referred to a Larger Bench by a co-ordinate Bench of this Court vide its order dated 9.9.2019 passed in Matters Under Article 227 No. 5718 of 2019. The questions referred to the Larger Bench are : (a) Under the facts and circumstances of the case what would be the minimum period of notice under Section 106 of the Transfer of Property Act, 1882 as substituted by the Central Act No. 3 of 2003? (b) Whether the amendment made by the Transfer of Property (Amendment) Act (Central Act No. 3 of 2003), would prevail over the U.P. Amendment by U.P. Act No. 24 of 1954 and consequently, the minimum period of notice would be 15 days? 3. In light of the aforesaid, list this petition after the reference is answered by the Larger Bench. 4. Meanwhile, the eviction of the petitioner from the demised premises in pursuance to the order dated 16.1.2018 passed by the Judge Small Causes Court, District Bareilly in S.C.C. Case No. 21/14 as affirmed by the Additional District Judge, Room No. 5, Bareilly vide his order dated 30.5.2019 passed in S.C.C. Revision No. 06 of 2018 shall remain stayed. Meanwhile, the petitioner shall deposit the arrears of rent due to him till date within one month from today and shall also keep on depositing the rent due by 7th of every month on which the rent is due. The landlord-respondent shall be entitled to withdraw the amount deposited by the petitioner. On failure of the petitioner to deposit the aforesaid amount, the interim order shall stand automatically vacated.
