ORDER 1. This bail application has been filed under Section 439 Cr.P.C in connection with FIR No.43/2022 registered at Police Station Purani, District Tonk for the offences under Sections 143, 323, 341, 34 & 307 of IPC. 2. Learned counsel for the petitioner submits that the petitioner is behind the bars since 26.03.2022 and he was not armed with knife. Counsel further submits that the petitioner has no criminal antecedents. Hence, the petitioner may kindly be released on bail. 3. Learned Public Prosecutor has opposed the bail application. 4. Heard. Perused the material available on the record. 5. As per the Police Statement of injured Mohd. Sayeed, the petitioner assaulted him with slap and fist. As per injury and X-Ray reports of Mohd. Sayeed, all injuries are caused by sharp (2 of 2) [CRLMB-5422/2022] weapon. Therefore, looking to the facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail. 6. Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the petitioner Shoab S/o Raees shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
