ORDER : 1. Heard Mr. R. Ali, learned counsel representing the petitioners as well as Ms. N. Das, learned Additional Public Prosecutor, Assam. 2. By this application filed under Section 438 Cr.P.C. the petitioners, namely (1) Ranjit Kumar Sah @ Ranjit Sah (2) Ravi Kumar Verma @ Ravi Varma (3) Ramesh Yadav @ Chattu and (4) Ajay Kumar Singh @ Shekhar Sah have prayed for pre-arrest bail in connection with Kheroni P.S. Case No. 78/2022 under Sections 341/324/354/143 IPC. 3. It is alleged in the FIR that while the informant and his two girlfriends were going somewhere, they were stopped by the present petitioners and kicked the informant and badly assaulted. 4. On the other hand, Mr. Ali has submitted that the true facts of the case is that the informant was causing disturbance after consuming liquor and, therefore, the petitioners had driven him out from that place and after that the informant has now lodged the present FIR. 5. Ms. N. Das, from the Case Diary, has submitted that the petitioners used sharp weapons but the simple injuries were caused to the informant. 6. I have given my anxious consideration to the submissions made by the learned counsels for both the sides. 7. Under the given circumstances this court is of the opinion that the petitioners do not deserve to be detained in custody for the aforesaid allegation. 8. Accordingly, it is directed that in the event of arrest of the petitioners namely (1) Ranjit Kumar Sah @ Ranjit Sah (2) Ravi Kumar Verma @ Ravi Varma (3) Ramesh Yadav @ Chattu and (4) Ajay Kumar Singh @ Shekhar Sah in connection with Kheroni P.S. Case No. 78/2022 under Sections 341/324/354/143 IPC, the arresting authority shall release them on bail of Rs. 25,000/- each with one surety of like amount to the satisfaction of the arresting authority. 9. The bail application is disposed of.
