JUDGMENT (Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of a writ of Certiorarified Mandamus, calling for the records pursuant to the impugned order of rejection passed by the 2nd respondent in the application No.TNAU04391400 of Bhavadharani. N.B, the Petitioner's daughter and quash the same with a consequential direction directing the respondents 1 and 2 to include the “Informatics Practices” as one of the eligibility criteria in its brochure and with further direction directing the Respondents 1 to 3 to grant admission to the Petitioner's daughter, Bhavadharani. N.B, in B.Sc., Agri course for the year 2021-22, by considering the “Informatics Practices” as equalent to “Computer Science”.) 1. By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself. 2. This writ petition has been filed challenging the order of the first respondent, rejecting the petitioner's application seeking admission to the B.Sc (Agricultural) course to any of the colleges falling under the second respondent University. The petitioner's application has been rejected under the impugned order. According to the petitioner, “Informatics Practices” subject is equivalent to a Computer Science course and the same is confirmed by the Central Board of Secondary Education (CBSE). However, under the impugned order, the second respondent/ University has rejected the petitioner's application seeking admission in B.Sc (Agricultural) course on the ground that the petitioner is not eligible by making an endorsement in the very same application submitted by the petitioner. Thereafter, the petitioner has given a representation on 11.04.2022 to the first respondent stating that Informatics Practices is equivalent to Computer Science subject and therefore, the petitioner is eligible to get admitted into the B.Sc (Agricultural) course. Since the said representation has not been considered till date, the petitioner has filed this application. 3. Heard Ms.Porkodi Karnan, learned counsel for the petitioner and Mr.Abdul Saleem, learned counsel for the respondents 1 and 2. 4. According to the petitioner, “Informatics Practices” and “Computer Science” subjects are one and the same for getting admitted into a B.Sc (Agricultural) course. The students will have to study Physics, Chemistry, Biology with any one of the fourth (elective) subject viz., Biotechnology, Microbiology, Biochemistry, Computer Science and Homescience. According to the petitioner, the elective subjects in Class - XII examination as Informatics Practices, is equivalent to Computer Science as per the CBSE regulations.
The students will have to study Physics, Chemistry, Biology with any one of the fourth (elective) subject viz., Biotechnology, Microbiology, Biochemistry, Computer Science and Homescience. According to the petitioner, the elective subjects in Class - XII examination as Informatics Practices, is equivalent to Computer Science as per the CBSE regulations. Therefore, according to the petitioner, he is eligible to apply for B.Sc course. 5. No prejudice would be caused to the respondents, if the petitioner's representation dated 11.04.2022 referred to supra is considered on merits and in accordance with law after affording a fair hearing to the petitioner, within a time frame to be fixed by this Court. 6. The issue involves admission to a particular course for a student, and therefore a decision will have to be taken by the respondents expeditiously within a time frame to be fixed by this Court. 7. For the foregoing reasons, this Court directs, the first respondent to pass final orders on the petitioner's representation dated 11.04.2022 referred to supra, within a period of two weeks from the date of receipt of a copy of this order after affording an opportunity of hearing to the petitioner. 8. With the aforesaid direction, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
