JUDGMENT 1. The petitioners' grievances that despite an order passed by the 1st Civil Judge, (Junior Division) at Howrah on July 7, 2003 appointing Joint Receivers (which has been subsequently modified to one receiver), private respondents being respondent nos. 6 & 7 are seeking to conduct Kali Puja at the suit premises. 2. Mr. Mukherjee, learned Counsel appearing on behalf of the respondent no. 5/learned Receiver submits that he has already made a complaint before the Inspector-in-Charge/respondent no. 4 intimating that the respondent nos. 6 & 7 are constructing a pandal with bamboos etc. on the suit property. Due to such construction, the embankment of the deity's property/suit property is being damaged. 3. The learned Receiver has been appointed for protection, preservation and management of the suit property. Therefore, the said unauthorized activities were brought to the knowledge of the respondent no. 4. 4. Mr. G.K. Choudhury, Learned Counsel appearing for the respondent nos. 6 & 7 submits that the Kali Puja at the said premises have been held since 1979. 5. Considering the relevant submissions of the parties and materials placed on record, this Court finds that respondent no. 5 has been appointed for protection and preservation of the suit property. No unauthorized construction without permission of the learned Civil Court can be done at the suit premises. 6. In the event, the Kali Puja is being conducted since 1979 at the side of the suit premises this Court expresses no opinion on continuance of the same. 7. The report of the Inspector-in-Charge, Bally Police Station/respondent no.4 filed in Court today is retained with the records. 8. In the circumstances, the respondent no. 4 is directed to ensure that no further damage to the suit property is made by rendering all assistance to the learned Receiver. The suit property being a 'Debottor' property has to be preserved and protected. 9. Let a detailed report be filed by the Inspector-in- Charge, Bally Police Station within November 18, 2022 upon completion of his investigation. 10. Let the matter now appear before the regular Bench. 11. All parties are directed to act on a server copy of this order, duly downloaded from the official website of this Hon'ble Court.
