Vishal Tiwari v. Union of India

D.Y.CHANDRACHUD, HIMA KOHLI

body2022
ORDER 1. Delay in refiling the petition is condoned. 2. The petitioner, who is an advocate, seeks an investigation into the protests which emerged upon the notification of the Agnipath Scheme by the Government. A close reading of the petition indicates that the petitioner seeks to challenge the validity of the Scheme by seeking the setting up of an expert committee chaired by a former Judge of this Court to examine the Scheme and 'its impact on National security and the Army of our nation'. 3. Petitions are pending before the High Court on the Scheme. Hence, it is not necessary for this Court to entertain the public interest litigation filed by an advocate. We dismiss the petition on that ground clarifying that we have not expressed any opinion on the merits of the Scheme. 4. Pending application, if any, stands disposed of.
