ORDER 1. There is a delay of 1850 days in filing the present Special Leave Petition. The poor lady has tried to place material on record seeking condonation of delay who lost her son in the alleged road accident which took place in March, 2003. 2. We have heard learned counsel for the parties on merits. 3. Delay condoned. 4. Leave granted. 5. The appellant herein is the unfortunate mother who lost her only son in the alleged accident which took place on 4th March, 2003 and in reference to which a Claim Petition was filed by the parents under Section 166 of the Motor Vehicles Act before the Motor Accident Claims Tribunal, Erode. 6. The Tribunal, after examining the material on record, awarded a compensation of Rs.1,37,000/- (Rupees one lakh thirty seven thousand only) with interest @ 9% per annum by Award dated 1st October, 2004 and that came to be challenged by the appellant before the High Court of Judicature at Madras for enhancement of compensation. 7. In the appeal at her instance, the High Court enhanced the awarded compensation to Rs.1,95,000/- (Rupees one lakh ninety five thousand only) keeping in view the age of the parents and also the age of the deceased under the impugned judgment dated 25th August, 2012. 8. Being aggrieved by the impugned order, the appellant-mother is before us. It is brought to our notice that the father has expired on 1st January, 2016. 9. Learned senior counsel for the appellant submits that 'Conventional Heads' has been primarily settled by the Constitution Bench judgment of this Court in the case of National Insurance Company Limited v. Pranay Sethi & Ors. (2017) 16 SCC 680 which has later been followed by this Court in The New India Assurance Company vs Somwati & Ors. (2020) 9 SCC 644 and submits that in the 'Conventional Heads', the appellant is entitled for further enhancement which has not been looked into by the High Court under the judgment impugned. 10. After we have heard learned senior counsel/learned counsel for the parties and taking into consideration the other 'Conventional Heads' Consortium/funeral expenses and loss of estate, we consider it appropriate to award a further lumpsum compensation of Rs.1,05,000/- (Rupees one lakh five thousand only) in addition to the compensation already awarded to the appellant under the judgment impugned. The enhanced compensation of Rs. 1,05,000/-(Rupees one lakh and five thousand only) as determined by this Court shall be deposited by the respondent-Insurance Company with the concerned Tribunal within a period of two months from today failing which it shall carry interest @ 7.5% per annum until its actual payment. 11. On such deposit being made, the Presiding Officer must ensure that the money shall be transferred directly to the bank account of the claimant. 12. The appeal stands disposed of in terms aforesaid. 13. Pending application, if any, also stands disposed of.
