JUDGMENT (Prayer: Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to G.O.Ms.No.45 Welfare of Differently Abled Persons [DAP 1-1] Department dated 21.05.2013 on the file of the 1st respondent and quash the same and consequently direct the 1st and 2nd respondents to consider the case of the petitioner for appointment to the post of Deputy Director in the office of the 2nd respondent.) 1. The writ petition is filed challenging the promotion of the third respondent to the post of Deputy Director of Differently Abled. 2. The counter filed by the Commissioner for the Differently Abled reveals that during the relevant point of time when the panel for promotion to the post of Deputy Director was prepared, the writ petitioner was not working in the feeder category of Assistant Director. The said position has been clarified in the counter and therefore, the case of the writ petitioner was not considered for promotion to the post of Deputy Director during the relevant point of time. 3. The writ petition is pending for the past about eight years. If at all, the petitioner is eligible for further promotion his case is to be considered in accordance with rules in force. However, in respect of the promotion of the third respondent to the post of Deputy Director, there is no irregularity or otherwise. 4. With these observations, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
