JUDGMENT D. Ramesh, J. - This petition is filed under Article 226 of the Constitution of India, seeking to declare the impugned notice dated 11.10.2022 issued by the 4th respondent -Tahsildar, in respect of the house site of the petitioner's Plot No.64 to an extent of 72 Sq.Yards, in R.S.No.581/2B of Krovvidi village of Nidamarru Mandal, Eluru District as illegal, arbitrary and consequently, to set aside the same. 2. Heard learned counsel appearing for the petitioner/s and learned Assistant Government Pleader for Revenue appearing for the respondents. 3. Learned counsel for the petitioner submitted that initially patta has been granted to the petitioner way back in the year 2019. Since then, the petitioner has been in possession of the property, now the respondents have issued the impugned notice on 11.10.2022, to which, the petitioner also submitted reply on 05.12.2022. But the respondents, without passing any final order, are trying to dispossess the petitioner from house site. Hence, the present writ petition. 4. Considering the submissions made by learned counsel of the petitioner and on perusal of the material on record, there shall be direction to the respondents not to dispossess and not to interfere with the possession of the petitioner over the subject property, pursuant to the notice dated 11.10.2022, without passing final order on the reply submitted by the petitioner on 05.12.2022. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
