JUDGMENT Amar Nath (Kesharwani), J. - The is first application filed under section 438 Cr.P.C seeking anticipatory bail as the applicant apprehends his arrest in connection with crime No.482/2022 registered at police station Khilchipur District Rajgarh for the offence punishable under section 326,294, 323,506, 34 of I.P.C. 2. As per prosecution story, on 03.10.2022, the complainant Mahaveerdas Tyagi lodged a Dehati Nalishi alleging that on 19.07.2022 at about 11:00 AM, he went to village Amvabata where applicant and other three were present. He asked them about the money collected by them for oblation due to which they assaulted the complainant. On the basis of this, the aforesaid FIR has been registered against the applicant and three other. 3. Learned counsel for the applicant submits that applicant is innocent and he has falsely been implicated in the present case. There is delay of two and half month in lodging the FIR. No fracture was found on the person of the complainant. It is further submitted that on the date of incident, no MLC has been conducted to the complainant. Co-accused- Vijay Singh has been granted regular bail by the trial court. 4. Learned Government Advocate opposes the bail application by submitting that the applicant has not disclosed the incident to anyone due to shame, when he felt ill, he disclosed the incident and lodged an FIR. Hence, bail application is liable to be dismissed. 5. Considering the facts and circumstances of the case and on perusal of the case diary, without commenting on the merit of the case, the application is allowed. It is directed that in the event of arrest of the applicant in connection with the aforesaid crime number, he shall be released on bail upon his furnishing personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount to the satisfaction of the arresting officer. This order shall be governed by the following conditions. (a) the applicant shall co-operate with the investigation and make himself available for interrogation by a police officer as and when required.
