ORDER 1. Delay condoned. 2. Leave granted. 3. The appellants before us are the legal representatives of a deceased officer of the Zilla Panchayat, Belgaum. He had succumbed to the injuries caused by an accident involving a motor vehicle. The accident had occurred on 19th July, 2017. Compensation claim of Rs. 1,05,00,000/- was made before the Motor Accidents Claims Tribunal, but total compensation awarded by the Tribunal was Rs. 40,30,104/-. In appeal, the High Court confirmed the sum awarded by the Tribunal as compensation. 4. Before us, argument has been advanced on behalf of the appellants for enhancement of compensation on two counts. The Tribunal and the High Court had applied split multiplier of 3 and 6, and argument of the appellant is that computing compensation applying split multiplier was impermissible in law in the facts of the present case. The multiplier of 9 was to be applied. Award of compensation on loss of future prospects has been omitted by the Tribunal and the High Court as well. In this case, computation of loss on future prospects would be 15%, the age of the deceased victim being 57 years. We agree with the appellants' submission on both these points. 5. So far as computation on other counts are concerned, we do not find any reason to interfere. 6. In such circumstances, we direct that compensation be computed in the following terms: Sl. No. Head Amount ( in Rs.) A Monthly Dependency Rs. 82,088/-w B Future prospects (15% of monthly dependency) Rs. 12,013/- C 1/3rd deduction towards personal expenses Rs. 31,367/- D Total Dependency (A+B - C) Rs. 62,734/- E Age multiplier 9 F Compensation ( DX12X9) Rs. 67,75,272/- G Loss of Estate Rs. 15,000/- H Funeral Expenses Rs. 15,000/- I Consortium ( Rs. 40,000/- + Rs. 40,000/- + Rs. 40,000/-) Rs. 1,20,000/- TOTAL Rs. 69,25,272/- 7. Let the said sum, adjusting therefrom any amount already received, be remitted to the petitioner. The sum which remained unpaid, upon factoring in this recomputation shall carry the interest of 7.5%. Such interest shall be calculated from the date of filing the claim petition till the date of realisation of the sum. The unpaid amount shall be remitted to the petitioners by the respondent no. 2 within a period of four weeks from the date of communication of this order. 8. The appeal stands disposed of in the above terms. 9.
