JUDGMENT Anupinder Singh Grewal, J. (Oral) - Heard through video conferencing. The petitioner is seeking anticipatory bail in FIR No.458 dated 27.10.2021, under Sections 323, 353, 186, 379-A IPC, registered at Police Station Sadar Nuh, District Nuh. 2. Learned counsel for the petitioner contends that it is alleged in the FIR that when the police party had gone to investigate a complaint made by one-Saraswati against her husband-Naresh, the petitioner and others had a scuffle with the police. It is a case of no injury as there is no MLR. It is alleged that I- card and cash of the complainant was taken away. The petitioner is a 30 year old lady and is not involved in any other criminal case. Issue notice to the respondent. 3. At the asking of the Court, Mr. Anant Kataria, DAG, Haryana, accepts notice on behalf of the respondent. He, upon instructions from ASI Virender contends that although the petitioner does not have any criminal antecedents but in view of the gravity of the offence alleged to have been committed by her, she is not entitled to the concession of anticipatory bail. Heard. 4. Without expressing any opinion on the merits of the case and in view of the above especially when the petitioner is a lady, she is not involved in any other case, I deem it a fit case to grant the concession of anticipatory bail to the petitioner. 5. Therefore, the petitioner is directed to appear before the investigating officer within a period of 15 days from the date of receipt of certified copy of this order and on her doing so, she shall be released on bail to the satisfaction of the arresting/investigating officer till submission of report under Section 173 of the Code of Criminal Procedure, 1973 ('Cr.P.C.' - for short). The petitioner shall continue to join investigation and shall furnish an undertaking that she shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. Thereafter, she will be permitted to furnish regular bail bonds to the satisfaction of the trial Court. 6. The petition stands disposed of in the aforementioned terms.
