ORDER : 1. The petitioner is not entitled to demand an in-camera hearing of the appeal filed by the State against the order of acquittal having due regard to the provisions of Section 327 of the Code of Criminal Procedure 1973. We decline to interfere with the impugned judgment of the High Court of Judicature at Bombay at Goa dated 24 November 2021. 2. Mr Kapil Sibal, senior counsel appearing on behalf of the petitioner, adverted to a communication of the Registrar (Judicial. I) on the Appellate Side of the High Court of Judicature at Bombay to his counterpart at Goa dated 9 September 2021 stating that the Chief Justice had directed that the hearing of the appeal shall take place through the virtual mode. 3. Mr Kapil Sibal submits that the petitioner would move the Division Bench of the High Court which is hearing the criminal appeal for a direction that the appeal be heard within the physical precincts of the High Court rather than on a virtual mode. 4. The High Court is entitled to decide whether the hearing should be in the physical court room or on a virtual mode. However, the request of the petitioner for an in-camera hearing has been rejected by the High Court, which stands affirmed by this Court. 5. The Special Leave Petition is dismissed. 6. Pending application, if any, stands disposed of.
