ORDER 1. Upon being mentioned, taken on board. 2. On 9 December 2022, a Single Judge of the High Court of Delhi rejected an application moved by the respondent under Section 14 of the Arbitration and Conciliation Act 1996['Act']. 3. The petitioners moved an application under Section 9 before the Single Judge for a direction that there is no interdict on the Tribunal proceeding ahead with the arbitral proceedings. 4. The Single Judge was apprised by counsel for the respondent that the respondent proposes to challenge the order dated 9 December 2022 rejecting the application under Section 14. 5. In view of deference to the above submission, the Single Judge has listed the proceedings under Section 9 on 16 December 2022. 6. The Special Leave Petition by the respondent against the order of the High Court dated 9 December 2022 is yet to be listed before this Court. In the absence of any injunction by this Court, the position clearly is that there is no restraint on the arbitral proceedings. 7. The present order does not constitute any expression of opinion on the merits of that Special Leave Petition instituted by the respondent. 8. The Special Leave Petition is disposed of accordingly. 9. Pending application, if any, stands disposed of.
