JUDGMENT Avneesh Jhingan, J. - This petition under Section 438 Cr.P.C. is filed seeking anticipatory bail in FIR No. 316 dated 14.7.2022, under Section 15 of the Narcotic Drugs & Psychotropic Substances Act, 1985 registered at Police Station Sadar Dabwali, District Sirsa. In the first petition, the following order was passed on 4.8.2022: 'This petition under Section 438 Cr.P.C. is filed seeking anticipatory bail in FIR No. 316 dated 14.7.2022, under Section 15 of the Narcotic Drugs & Psychotropic Substances Act, 1985 registered at Police Station Sadar Dabwali, District Sirsa. One of the ground for seeking anticipatory bail is that brother of the petitioner had filed a complaint against the police officials which is still pending. After arguing for some time, learned counsel for the petitioner does not press the present petition. However, a request is made that the petitioner would surrender before the Illaqa Magistrate/Chief Judicial Magistrate within ten days from today and apply for regular bail, his application be taken up expeditiously. The petition is disposed of. In case the petitioner surrenders within ten days from today and applies for regular bail, the court concerned shall take up the bail application within one day and decide it as expeditiously as possible.' 2. Learned counsel for the petitioner realising that in the first petition the above mentioned order was passed, to avoid adverse order seeks permission to withdraw the present petition. Dismissed as withdrawn.
