ORDER : 1. At the request of learned counsel for the petitioner, the defect(s), as pointed out of by the office, is ignored. 2. The present writ petition has been filed for issuance of direction upon the respondents to consider the application submitted by the petitioner in pursuance of expression of interest bearing no.60/SMC/68/Tender/2015 dated 3rd July, 2019 (Annexure-1 to the writ petition) invited for empanelment of hospitals/nursing homes/clinics/ radiology centres for providing secondary care treatment to insured persons and their eligible dependants at CGHS/AIIMS/ESIC rate. 3. Mr. Ashutosh Anand, learned counsel for the respondents, while referring to letter dated 29th September, 2021 (Annexure-7 to the writ petition) issued by the State Medical Officer, Employees’ State Insurance Corporation, Regional Office, Jharkhand, Ranchi to the petitioner, submits that it has already been clarified that at present there is no possibility of executing MoU with any hospital in pursuance of expression of interest in question and any hospital would be considered finally for its empanelment after publishing the next advertisement in that regard. 4. Considering the said fact, no writ of mandamus can be issued to the respondents on the prayer made by the petitioner in the present writ petition. 5. The writ petition is, accordingly, disposed of. 6. The petitioner is, however, at liberty to apply afresh before the respondents for its empanelment, if any advertisement/ expression of interest is issued in future for the said purpose.
