JUDGMENT (Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to grant permission and necessary protection to conduct Aadalum Padalum programme scheduled to be held on 10.08.2022 from 06.00 pm for Arulmighu shri Kaliyamman Temple Festival situated at North Paraipatti Village, Kila Thiruvengadam, Tenkasi District, based on the petitioners representation dated 20.07.2022 and 05.08.2022.) 1. The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus directing the respondents to grant permission and necessary protection to conduct Aadalum Padalum programme scheduled to be held on 10.08.2022 from 06.00 pm for Arulmighu shri Kaliyamman Temple Festival situated at North Paraipatti Village, Kila Thiruvengadam, Tenkasi District, based on the petitioners representation dated 20.07.2022 and 05.08.2022. 2. The learned Government Advocate (Criminal Side) takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself. 3. The learned counsel appearing for the petitioner submitted that there is a Krishna Jeyanthi Thiruvizha in the temple, by name, Arulmighu shri Kaliyamman Temple Festival situated at North Paraipatti Village, Kila Thiruvengadam, Tenkasi District on 10.08.2022. Subsequent to the same, in order to conduct a cultural programme on 10.08.2022, they sought permission of the police by giving a representation dated 20.07.2022 and 05.08.2022. But, the third respondent has not considered the said representation. Since no order was passed, the petitioner has come before this Court for the above said relief. 4. The learned Government Advocate (criminal side) appearing for the respondent police would submit that on 10.08.2022, permission was already granted to conduct temple festival for 15 temples and hence it is not possible to provide security if the permission is granted. 5. In response, the learned counsel for the petitioner submitted that he is ready to give fresh representation before the third respondent for conducting the temple festival. 6. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (criminal side) appearing for the respondent police. 7. The petitioner is at liberty to approach the third respondent and to give a fresh representation for conducting adal padal and on receipt of the fresh representation, the third respondent is hereby directed to consider the same and pass suitable orders based on the circular issued by Director General of Police, Tamil Nadu, Chennai in a circular memorandum in Rc.007301/Genl.I (1)/2019, dated 09.04.2019 9. With the above direction, this writ petition is disposed of. No cost.
