JUDGMENT : ARUN BHANSALI, J. 1. It is submitted by the petitioner that the petitioner has been pursuing his case for regularization on the post of Bin Keeper, wherein, initially his petition was disposed of on 21.08.2013, the respondents were directed to consider the case of the petitioner for regularization in the light of directions issued by the Hon'ble Supreme Court in the case of State of Karnataka vs. Uma Devi, (2006) 4 SCC 1 . 2. The special appeal filed by the respondents came to be disposed of by the Division bench on 04.12.2018, wherein, it was held by the Division Bench that the appellant therein cannot have any grievance to the directions issued and the statement of the appellant therein, was also noticed that they were not intended to terminate the services of the petitioner, however, instead of offering regularization of petitioner's service as Bin Keeper pursuant to the directions issued by this Court way back on 21.08.2013, an offer letter dated 15.01.2022 (Annex.20) has been issued to the petitioner for regularization as worker grade III and simultaneously, he has been ordered to be stationed at Kota, whereas, for all these years the petitioner has been working at Sri Ganganagar. 3. It is submitted that actions of the respondents, in offering the regularization as worker grade III instead of Bin Keeper and seeking to transfer from Sri Ganganagar to Kota, is not justified in view of the various orders passed by this Court regarding the regularization of the petitioner. 4. In view of the submissions made, issue notice. Issue notice of the stay application also, returnable within a period of four weeks. 5. Notices when issued be given ‘dasti’ to the petitioner/counsel for the petitioner. 6. In the meanwhile and until further orders, operation of the order dated 15.01.2022 (Annex.20) shall remain stayed.
