JUDGMENT (Prayer: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider and take appropriate action on the representation dated 17.03.20222 & 30.03.2022 submitted by the petitioner for executionof sale deed in favour of the petitioner with regard to MIG Flat, M.19/G1 (Ground Floor) at Thiruvanmiyur extension, Thiruvanmiyur, Chennai – 600 020 forthwith.) 1. This writ petition has been filed for a mandamus seeking for a direction to the respondents to pass orders in the petitioner's representations dated 17.03.2022 and 30.03.2022 requesting forexecution of sale deed in her favour in respect of the property being MIG Flat, M.19/G1 (Ground Floor) at Thiruvanmiyur extension, Thiruvanmiyur, Chennai – 600 020 within a time frame to be fixed by this Court. 2. The petitioner claims that she has been allotted the aforementioned flat in January, 1992 by the respondent Housing Board. According to her, she has paid the entire sale consideration in the year 2012. It is also stated that she has been sending several representations to the respondents to execute sale deed in her favour thereafter. The petitioner also claims that she has also discharged the loan. The petitioner has given representations on 17.03.2022 and 30.03.2022 to the respondents requesting them to execute the sale deed in her favour. Since the representations have not been considered till date, she has filed this writ petition. 3. Heard Mr.Prakash Adiapadam, learned counsel for the petitioner and Mr.D.Veerasekaran, learned counsel for the respondents. 3. No prejudice would be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance with law after affording a fair hearing to the petitioner. The petitioner claims that she is in possession of the properties and has paid the entire sale consideration pursuant to the allotment made in her favour. 4. For the foregoing reasons, this Court directs the third respondent to pass final orders on the petitioner's representations dated 17.03.2022 and 30.03.2022 requesting the third respondent to execute the sale deed in her favour in respect of the MIG Flat, M.19/G1 (Ground Floor) at Thiruvanmiyur extension, Thiruvanmiyur, Chennai – 600 020 within a period of twelve weeks from the date of receipt of a copy of this order after affording a fair hearing to the petitioner. 5. With the aforesaid direction, the writ petition is disposed of. No costs.
