JUDGMENT (Common Prayer: Civil Revision Petition filed under Article 227 of Constitution of India against the order dated 30.01.2017 passed in E.A.Nos.16, 17 & 43 of 2013 in E.P.Nos.396, 397 & 412 of 2012 in R.C.O.P.Nos.538, 539 & 585 of 2012 passed by the XIV Court of Small Causes, Chennai, the impugned order is suffered with manifest error and An error apparent on the face of the record.) Common Order 1. The report of the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, has been received indicating that the matters referred to Mediation had ended successfully as parties entered into a memorandum of joint compromise. The memorandum of joint compromise has been filed before this Court. It has been enclosed along with the report of the Tamil Nadu Mediation and Conciliation Centre. 2. The petitioners, Lakshmi W/o.late K.Subramanian, S.Padmanabhan S/o.late K.Subramanian, S.Kani S/o.late K.Subramanian and Amala D/o.late K.Subramanian are present along with their counsel. Similarly, the respondent, D.Gajendran S/o.late Dakshinamurthy is also present along with his counsel. 3. Both the parties affirmed the memorandum of joint compromise already entered into during the course of Mediation. The property has to be enjoyed in two separate portions. The Blue marked portion in the plan annexed will be enjoyed by the petitioners and the Red marked portion in the plan will be enjoyed by the respondent. 4. The parties have been examined by me. They are present in Court. They affirmed entering into the joint compromise and their signatures in the joint compromise memo. 5. The joint compromise memo is accordingly recorded. The Civil Revision Petitions are allowed in accordance with the joint compromise memo. The joint compromise memo shall form part of the Civil Revision Petitions. No costs. Consequently, connected miscellaneous petitions are closed. 6. The Registry may forward this order along with the joint memorandum of compromise and the sketch to the XIV Court of Small Causes, Chennai and issue a direction that the XIV Court of Small Causes, Chennai, shall incorporate the memorandum of joint compromise in the form of common decree in E.P.Nos.396 of 2012 in R.C.O.P.No.538 of 2012, E.P.No.397 of 2012 in R.C.O.P.No.539 of 2012 and E.P.No.412 of 2012 in R.C.O.P.No.585 of 2012.
The decree so framed by the Court may be presented by the petitioners herein viz., the legal representatives of K.Subramanian before the jurisdictional Sub- Registrar Office and a direction is given to the Sub Registrar to register the decree in accordance with the provisions of the Registration Act.
