ORDER : 1. The present case is taken up through video conferencing. 2. The petitioners, who were the President and Secretary respectively of Nawadih @ Teliyadih Panchayat during the relevant period, have filed the present writ petition for directing the respondents to pay dues of Rs. 1,22,400/- along with suitable interest to them out of the fund allocated by the 13th Finance Commission during the year 2014-15 for construction of PCC road from Dhibar Total to Shibu Saw’s Home of the said Panchayat. 3. Learned counsel for the respondents at the outset submits that since the aforesaid work was purportedly carried out by the petitioners out of the fund allocated by the 13th Finance Commission for the year 2014-15, which has now lapsed, the present writ petition is not worth consideration at this belated stage. 4. Having heard the learned counsel for the parties and keeping in view that the fund allocated by 13th Finance Commission has already lapsed by now, no writ of mandamus can be issued as prayed by the petitioners in the present writ petition. The petitioners have also not given any cogent reason in the present writ petition justifying the delay committed in filing the present writ petition particularly in view of the fact that the aforesaid work was said to be completed in the month of August, 2015 itself as would be evident from the work completion certificate issued by the concerned engineers on 12.08.2015 (Annexure-7 to the writ petition). 5. The writ petition is accordingly dismissed.
