JUDGMENT P. B. Bajanthri, J.— Heard learned counsel for the parties. 2. In the instant petition, petitioner has prayed for the following relief/reliefs:— “That the petitioner is invoking the writ jurisdiction of this Hon’ble Court for issuance of appropriate writ/writs, order/orders or direction/directions commanding upon the respondent authorities: I. For quashing the Letter No.06 dated 24.09.2020 issued under signature of the Project Officer, Centre of Excellence, Desri, Vaishali (respondent No.6), who has removed the petitioner from the post, as a vehicle driver on the basis of daily baizes duty. II. For reinstating the petitioner on the post, as a vehicle driver on the basis of daily baizes duty. III. For any other relief/reliefs for which the petitioner is entitled in the eye of law.” 3. Paragraph no. 18 of the counter affidavit reads as under:— “That from the facts as stated herein above it is obvious that the petitioner as Dhala driver has been removed in view of the recommendation of Project Officer, Centre for Excellence, Desari, Vaishali, who found the petitioner negligent and deficient in discharge of his duty. At Present District Horticulture Office, Aurangabad is not using the dhala Vehicle, Assistant Director Horticulture, Aurangabad using the Vehicle on the rent basis from 01.09.2020 and same driver is driving the Vehicle from 07.11.2020 to till now.” 4. In the light of the aforesaid statement on behalf of the official respondents, the present petition do not survive for consideration. 5. Accordingly, the present petition stands disposed of. 6. If petitioner is entitled to any monetary benefits, the same shall be extended within a period of one month from the date of receipt of this order.
