ORDER/JUDGMENT : – Shri Sushil Kumar Tiwari, counsel for the applicant. Ms. Soumya Dixit, Panel Lawyer for the respondent-State. Heard. 2. This third application under section 439 of the Code of Criminal Procedure has been filed on behalf of the applicant for grant of bail in connection with Crime No. 211/2019, registered at Police Station Umariya District Umariya, for the offence punishable under sections 294, 323, 506, 325 and 302/34 of Penal Code. 3. Earlier application of the applicant was dismissed as withdrawn vide order dated 15-7-2021. 4. Counsel for the applicant submits that the applicant is in jail since 16-5-2019. He further submits that other co-accused facing the same allegation namely Deepchand Kachi has been released on bail. Counsel for the applicant submits that the incident was occurred due to free fight between the parties and both the parties have sustained injuries. A counter case has also been registered. On these grounds he prays for grant of bail to the applicant. 5. Counsel for the respondent-State though has opposed the bail application, but failed to demonstrate that the case of the present applicant is distinguishable with that of other co-accused person, who has been released on bail. 6. Considering the overall facts and circumstances of the case, though bail application has been opposed by counsel for State but to maintain parity, I am inclined to allow this bail application. Without commenting anything on the merits of the case this bail application is allowed. 7. It is directed that the applicant be released on bail upon his furnishing a personal bond in the sum of Rs. 80,000/- (Rupees Eighty Thousand) with one solvent surety of the like amount to the satisfaction of the trial Court concerned for his appearance on the dates given by it. 8. It is further directed that the applicant shall abide by the conditions enumerated in section 437(3) of the Code of Criminal Procedure.
