JUDGMENT Alok Kumar Verma, J. - An Original Suit (No. 538 of 2018) was filed by Mr. K.L. Batra through his attorney, his son Arun Batra, the revisionist herein. Mr. K.L. Batra died during the pendency of the said Original Suit. The revisionist moved an application for substitution. The said substitution application has been dismissed vide impugned order dated 11.12.2019 holding that the grandson of the deceased and the son of the revisionist should also be substituted. Hence, the present Revision. 2. Heard Mr. S.K. Jain, learned Senior Advocate. 3. The present Revision has already been directed to be proceeded ex-parte against the respondents. 4. Mr. S.K. Jain, learned Senior Advocate, submitted that according to the registered Will dated 28.04.2014 of the deceased K.L. Batra, his son, Arun Batra, revisionist and his grandson, Karan Batra shall be the only beneficiaries of his last Will, and, according to the another Will dated 28.04.2014, executed by the deceased K.L. Batra, the present revisionist has been appointed as Executor of his Will. 5. During the arguments, Mr. S.K. Jain, learned Senior Advocate, submitted that the revisionist is agree to implead his son Karan Batra, grandson of the deceased, original plaintiff, as plaintiff along with him. 6. In view of the said submissions of the learned Senior Advocate, the impugned order dated 11.12.2019, passed in Original Suit No. 538 of 2018, is set aside. Liberty is granted to the revisionist to move a fresh substitution application before the Court concerned within 15 days from today, and, the Court concerned is directed to consider and decide the substitution application, which will be filed by the present revisionist Mr. Arun Batra along with Mr. Kran Batra, in accordance with law. 7. The present Civil Revision (No. 4 of 2020) is allowed accordingly.
