JUDGMENT : RAJESH SHANKAR, J. 1. The present writ petition has been filed for issuance of direction upon the respondents to release the entire contractual dues in favour of the petitioner for executing the ordinary repair work from KM-226 to KM-233 of NH-80 for the year 2019-20 pursuant to Agreement No. 23 F2 of 2019-20. 2. Learned counsel for the petitioner submits that the petitioner duly executed the said work pursuant to Agreement No. 23 F2 of 2019-20 for agreement value of Rs. 18,70,402.50 and a certificate to that effect was also issued to the petitioner by the respondent No.4 vide letter No. 642 dated 10.07.2020. Despite completion of the said work to the satisfaction of the concerned authorities, the petitioner has not been paid any amount, except the security amount deposited by him at the time of execution of the said agreement. The petitioner represented the said respondent on various occasions, however, the same remained un-responded, which has compelled him to prefer the writ petition. 3. Mr. A.A. Andrew, A.C. to Ms. Khushboo Kataruka, learned counsel for the respondent-NHAI, while producing a copy of letter No. 815 dated 26.03.2022 issued by the respondent No.3 to the respondent No.4, submits that the NHAI has made Rs. 42,37,510/- available to the respondent No.4 for the propose of making payment to the petitioner and one Manoj Kumar Saha for executing the ordinary repair work from KM-226 to KM-233 and from KM-234 to KM-243 respectively of NH-80 for the year 2019-20. 4. Considering the said submission of learned counsel for the respondent-NHAI, the respondent No.4 is directed to take appropriate steps for payment of the admitted amount to the petitioner for the work in question within four weeks from the date of receipt/production of a copy of this order. 5. The present writ petition is accordingly disposed of with the aforesaid direction. 6. Let copy of letter No. 815 dated 26.03.2022 be kept on record.
