ORDER : The C.M.P. is taken up today through Video conferencing. The present civil miscellaneous petition has been filed by petitioner-Bharat Petroleum Corporation Limited for modification of order dated 3rd September, 2021 passed by this Court in W.P.(C) No. 3648 of 2019 to the extent that the said Corporation may be allowed to carry on its work at the site on deposit of the compensation as determined by the district administration of Bokaro as well as to allow the petitioner to carry on the construction of the depot at Radhanagar, Bokaro, as it has already deposited the amount of compensation determined by the district administration of Bokaro in compliance of the aforesaid order passed by this Court. 2. Reference may be made to order dated 08.04.2022, the relevant part of which reads as under: “Mr. Amar Kumar Sinha, learned counsel for the opposite party nos. 1 to 5, submits that the said opposite parties have received notices dated 31.03.2022 issued by the District Land Acquisition Officer, Bokaro calling upon them to approach the said authority along with relevant documents relating to the land in question so as to receive appropriate compensation. It is further submitted that the opposite party nos. 1 to 5 have no intention to delay the matter and they are ready to receive the lawful compensation for acquisition of their respective land. It is also submitted that the said opposite parties will appear before the District Land Acquisition Officer, Bokaro on 11.04.2022 itself along with relevant documents in support of their claim over the land in question. Learned counsel for the opposite party nos. 1 to 5, however, prays for two weeks’ time to file counter affidavit on the said aspect. Put up this case on 22.04.2022 under appropriate heading.” 3. Though no counter affidavit has been filed on behalf of the opposite party nos. 1 to 5, yet Mr. Amar Kumar Sinha, leaned counsel for the said opposite parties, on instruction, submits that the opposite party nos. 1 to 5 have already received compensation amount under protest from the competent authority. 4. In view of the said development, Mr. Amar Kumar Sinha, learned counsel for the opposite party nos. 1 to 5, submits that there is no reason as to why the opposite party nos.

Considering the said facts and circumstance, there is no need to further proceed in the present C.M.P. The same is accordingly disposed of.
