ORDER Heard Ms. Nivedita Nirvikar, learned senior counsel for the petitioner and Mr. Chandra Sen Prasad Singh, learned APP for the State. 2. This is the second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier bail application of the petitioner was dismissed vide order dated 22.02.2022 passed in Cr. Misc. No. 33567/2021 with an observation to renew the prayer for bail after three months. 3. The allegation against the petitioner is that the petitioner along with other accused persons executed the sale deed of the land belonging to the informant’s grand father. 4. Learned senior counsel for the petitioner submits that from perusal of the FIR, it would be evident that the only allegation against the petitioner is that he has merely signed the sale deed as a witness. She further submits that the present case gave rise to Title Suit No. 114/2021 (Annexure-3) having been filed against the petitioner and others making them defendants. Learned counsel next submits that the petitioner is in custody since 22.02.2021, the charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences. 5. Regards being had to the submissions made by the parties and taking into consideration the fact that this is the second attempt for bail on behalf of the petitioner, he is in custody since 22.02.2021, the charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner. 6. Accordingly, let the petitioner, namely, PAPPU KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Patna in connection with Phulwarisharif (Janipur) PS Case No. 185/2021.
