JUDGMENT 1. Grievance ventilated by the petitioner through this petition, styled as PIL, is that the Government land, which is allotted for the purpose of play ground in the Government School at Villate Naharkheda, District alwar, has been encroached upon by number of persons and despite various representations made to Tehsildar, Tehsil Mundawar, District alwar as also various communications made by the Principal of the aforesaid school, encroachment has not been removed and proceedings have not been drawn. 2. Since the allegation pertains to encroachment on the Government land, which is said to be used for play ground of Government School, the complaint is required to be enquired into by Tehsildar concerned. 3. Since it is the allegation of the petitioner that enquiry has not been made in the case and encroachment continues, we consider it appropriate to direct Tehsildar, Tehsil Mundawar, District alwar to examine the complaint regarding encroachment over the land of play ground of Government School. Tehsildar shall initiate the enquiry in the matter in accordance with the provisions of law and after drawing necessary proceedings, shall remove the encroachment, if any found on the land of play ground as alleged in the writ petition. The enquiry shall be completed at the earliest, preferably within a period of three months from the date of receipt of copy of this order. 4. We direct the petitioner to serve a copy of this order to the District Collector, alwar as also Sub Divisional Officer, Mundawar, District alwar so that they may also issue necessary direction to Tehsildar, Tehsil Mundawar, District alwar for completion of enquiry on the allegations of encroachment. 5. The writ petition is, accordingly, disposed off at this stage.
